Terms of Service

By accessing or using BlogPump ("Service"), you agree to be bound by these Terms of Service. If you do not agree, you must not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.FOKUS SOLUTIONS LTD reserves the right to modify these Terms at any time by posting the revised version on this page. Continued use of the Service after any modification constitutes acceptance of the updated Terms.

The Service is intended for users who are at least 18 years of age. By using the Service, you represent and warrant that you are at least 18 years old.

BlogPump is an AI-powered SEO content creation platform that enables users to generate, manage, schedule, and publish blog articles. The Service includes, but is not limited to:

• AI-powered article generation in 13+ languages using advanced language models.
• AI image generation for featured images and inline content.
• Content scheduling, calendar management, and auto-publishing.
• Platform integrations (WordPress, Webflow, Ghost, Shopify, Wix, Zapier, Webhooks).
• Search engine indexing (Google, Bing, Yandex, Seznam, Naver).
• Workspace and multi-project management.
• SEO scoring, keyword optimisation, and metadata management.
• API access for programmatic content management.

To use certain features, you must create an account. You agree to:

• Provide accurate, complete, and current registration information.
• Maintain the confidentiality and security of your login credentials.
• Accept full responsibility for all activities that occur under your account.
• Notify us immediately at info@blogpump.com of any unauthorised access or security breach.

You may not share your account, use another user's account, or create multiple accounts for abusive purposes. We reserve the right to suspend or terminate accounts that violate these Terms.

4.1 Plans & Credits

The Service is offered through subscription plans with varying credit allocations and feature access:

• Free — 6 credits per month (~3 articles), 1 workspace, limited features.
• Pro — 120 credits per month (~60 articles), 5 workspaces, full integrations.
• Advanced — 480 credits per month (~240 articles), 15 workspaces, priority support.
• BYOK — 480 credits per month, use your own OpenAI API key, 10 workspaces.

Credits are consumed by article generation (2 credits per article per language), image generation (1–3 credits), translations (2 credits per language), and other AI-powered features. Unused credits do not roll over to the next billing cycle.

4.2 Billing & Payment

• All prices are in USD and exclude applicable taxes.
• Subscriptions are billed monthly in advance via Stripe.
• Subscriptions automatically renew unless cancelled before the renewal date.
• You may upgrade, downgrade, or cancel your plan at any time from your account settings.
• Downgrades and cancellations take effect at the end of the current billing period.

4.3 Refunds

We offer refunds at our sole discretion on a case-by-case basis. If you are unsatisfied, contact us at info@blogpump.com within 14 days of your initial purchase. Credits already consumed are non-refundable.

4.4 Payment Failures

If a payment fails, we may retry the charge. If payment remains unsuccessful after reasonable attempts, we may downgrade your account to the Free plan or suspend access to paid features.

If you subscribe to the BYOK plan:

• You provide your own OpenAI API key, which is encrypted and stored securely on our servers.
• You are solely responsible for your OpenAI account, usage, billing, and compliance with OpenAI's terms.
• FOKUS SOLUTIONS LTD is not liable for any charges, rate limits, or issues arising from your use of your own API key.
• You may revoke or change your API key at any time through your account settings.

6.1 Your Content

You retain all ownership rights in the content you create, upload, or input into the Service ("User Content"). By using the Service, you grant FOKUS SOLUTIONS LTD a limited, non-exclusive, worldwide licence to store, process, and transmit your User Content solely as necessary to provide and operate the Service.

6.2 AI-Generated Content

Content generated by our AI tools is provided for your use. You may use, modify, publish, and commercialise AI-generated content without restriction. However:

• You are solely responsible for reviewing, editing, and fact-checking AI-generated content before publication.
• FOKUS SOLUTIONS LTD does not guarantee the accuracy, originality, or fitness for any particular purpose of AI-generated content.
• AI-generated content may occasionally contain errors, inaccuracies, or biased language.

6.3 Our Intellectual Property

The Service, including its design, source code, features, functionality, trademarks, and all original content (excluding User Content and AI-generated content) is owned by FOKUS SOLUTIONS LTD and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

You agree to use the Service only for lawful purposes. You must NOT:

• Generate content that is illegal, defamatory, obscene, harassing, or violates the rights of others.
• Create content that infringes on any third-party intellectual property rights.
• Generate spam, phishing material, malware, or deceptive content.
• Generate content promoting hate speech, violence, discrimination, or terrorism.
• Attempt to gain unauthorised access to our systems, servers, or other users' accounts.
• Use automated tools (bots, scrapers) to access or overload the Service beyond normal API usage.
• Resell, sublicence, or redistribute the Service or access to it without written authorisation.
• Circumvent any usage limits, credit restrictions, or security measures.
• Violate any applicable local, national, or international laws or regulations.

Violation of this policy may result in immediate account suspension or termination without refund.

The Service allows you to connect third-party platforms (WordPress, Webflow, Ghost, Shopify, Wix, Zapier, custom webhooks). By using integrations:

• You authorise FOKUS SOLUTIONS LTD to access and publish content to your connected platforms on your behalf.
• You are responsible for maintaining valid credentials and permissions on those platforms.
• FOKUS SOLUTIONS LTD is not liable for any issues, data loss, or disruptions caused by third-party platform outages, API changes, or misconfigurations.
• Integration credentials are stored encrypted and can be revoked at any time.

9.1 "AS IS" Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee of Results

FOKUS SOLUTIONS LTD does not guarantee any specific SEO rankings, search engine positions, traffic increases, or business outcomes from using the Service. Search engine algorithms are beyond our control.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOKUS SOLUTIONS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, HOWEVER CAUSED, WHETHER IN CONTRACT, TORT, OR OTHERWISE.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO FOKUS SOLUTIONS LTD IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9.4 Third-Party Services

FOKUS SOLUTIONS LTD is not responsible for the availability, accuracy, or reliability of third-party services, APIs, or platforms integrated with the Service, including but not limited to OpenAI, Stripe, Google, and connected CMS platforms.

You agree to indemnify, defend, and hold harmless FOKUS SOLUTIONS LTD, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service or any content you create, publish, or distribute.
• Your violation of these Terms or any applicable law.
• Your infringement of any third-party rights, including intellectual property rights.
• Any claim arising from content published to third-party platforms via your integrations.

11.1 Termination by You

You may terminate your account at any time through Settings or by contacting info@blogpump.com. Upon cancellation, your subscription remains active until the end of the current billing period. You may export your content before account closure.

11.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice or liability, for:

• Material or repeated violation of these Terms.
• Fraudulent, abusive, or illegal activity.
• Non-payment after reasonable collection attempts.
• Upon request by law enforcement or government authorities.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account data within 30 days, except where retention is required by law. Sections 6, 9, 10, 12, and 13 survive termination.

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved as follows:

1. Informal Resolution — the parties shall first attempt to resolve the dispute through good-faith negotiation for a period of 30 days.
2. Mediation — if informal resolution fails, the dispute shall be submitted to mediation under the rules of the Centre for Effective Dispute Resolution (CEDR).
3. Jurisdiction — if mediation fails, the dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12.3 Company Information

• Entire Agreement — these Terms, together with the Privacy Policy, constitute the entire agreement between you and FOKUS SOLUTIONS LTD regarding the Service.
• Severability — if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver — failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment — you may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• Force Majeure — FOKUS SOLUTIONS LTD shall not be liable for any failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, labour disputes, government actions, internet or power outages, or third-party service failures.
• Notices — we may send notices to the email address associated with your account. You are responsible for keeping your email address current.
